Welcome to Ponderly Robotics Oy ("Ponderly," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, online shop, dashboard, and SaaS services (collectively, the "Services"), including any content, functionality, and services offered on or through the Services.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
Our Services include an online shop for purchasing TimeBuddy IoT cubes, DIY kits, and related products; a dashboard for managing your sensors; and a SaaS platform for tracking analytics data (excluding location information). The sensors are physical devices held by users, and the SaaS provides best-effort availability on the free tier, 99.9% uptime on the pro plan, and 99.99% uptime on the enterprise plan.
To access certain features of the Services, you may need to create an account. You must provide accurate and complete information during registration and keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
We offer free, pro, and enterprise plans. Payments for paid plans are processed through secure third-party providers. You agree to pay all fees associated with your plan. We may change pricing with notice. No refunds are provided except as required by law.
We collect and track analytics data from your use of the Services, including sensor activity for productivity insights. We do not collect or track location data. All data processing complies with our Privacy Policy. You grant us a non-exclusive license to use aggregated, anonymized data for improving the Services.
We strive to provide reliable Services:
If uptime falls below the guaranteed level for paid plans, we will provide compensation as service credits equal to the percentage of downtime beyond the guarantee, applied to the next billing cycle. Compensation is your sole remedy for downtime. We are not liable for free tier downtime.
The Services, including all content, features, and functionality, are owned by Ponderly or its licensors and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Services without our written permission. As an open-source product, certain components of TimeBuddy (e.g., sensor guides) may be licensed under open-source terms as specified.
You agree not to use the Services for unlawful purposes, infringe on third-party rights, or interfere with the Services. You are responsible for your sensors and any data you input or track.
The Services are provided "as is" without warranties. We are not liable for indirect, consequential, or special damages. Our total liability is limited to fees paid in the last 12 months.
We may terminate or suspend your access to the Services at any time for violation of these Terms. Upon termination, your account and data may be deleted.
These Terms are governed by the laws of Finland. Disputes shall be resolved in Helsinki courts.
We may update these Terms with notice. Continued use constitutes acceptance.
